Terms of Service & Data Contribution Agreement

Effective Date: July 11, 2026

Company: ne1, EMBR LLC, including its affiliates, officers, directors, employees, contractors, researchers, advisors, agents, licensors, service providers, successors, and assigns, collectively “ne1,” “we,” “us,” or “our.”

Platform: The ne1 website, mobile application, dashboards, databases, forms, community tools, research tools, publications, APIs, and related services, collectively the “Platform.”

These Terms of Service and Data Contribution Agreement, together with our Privacy Notice and any posted supplemental terms, form a legally binding agreement between you and ne1. By creating an account, accessing the Platform, submitting data, clicking “I agree,” or otherwise using the Platform, you agree to these Terms.

ne1 does not provide medical advice and is not a clinical, treatment, pharmacy, or emergency service. All health-related decisions must be made with a qualified licensed medical professional.
01

Key Terms in Plain Language

ne1 is a data-sharing and research platform. We collect self-reported, user-contributed information about individual experiences, including n-of-1 self-experiments, health observations, outcomes, laboratory values, wearable data, lifestyle variables, medications, supplements, peptides, research compounds, and other exposures that users choose to report.

ne1 does not provide medical advice. ne1 does not recommend, encourage, prescribe, supply, sell, endorse, validate, supervise, or condone the use of any peptide, research chemical, medication, supplement, drug, biologic, compounded product, investigational substance, or other compound. The Platform is not a clinical trial, treatment program, physician practice, pharmacy, laboratory, compounding service, telehealth service, adverse-event monitoring service, or emergency service.

All health-related decisions must be made with a qualified licensed medical professional. You should not start, stop, dose, combine, inject, ingest, apply, purchase, compound, import, or otherwise use any compound based on anything you see on ne1.

By submitting data, you give ne1 permission to use that data, including in de-identified, pseudonymized, aggregated, coded, statistical, and derivative forms, for retrospective research, IRB-reviewed or IRB-determined studies, academic publications, conference presentations, preprints, public reports, social-media content, educational materials, analytics, model development, product improvement, and other research or public-interest purposes described in these Terms.

We will make reasonable efforts to protect your privacy and to avoid publishing information that directly identifies you. However, no platform, database, publication, or de-identification method can guarantee absolute anonymity, confidentiality, security, or zero risk of re-identification.

02

Eligibility

You may use the Platform only if you:

  1. are at least 18 years old;
  2. have legal capacity to enter into this agreement;
  3. are submitting information about yourself only, unless ne1 has expressly authorized another submission method in writing;
  4. are not prohibited from using the Platform under applicable law;
  5. agree to comply with these Terms, the Privacy Notice, and all applicable laws.

You may not submit data about minors, dependents, patients, clients, family members, friends, or any other third party unless ne1 has provided a specific authorized workflow and you have all legally required rights, consents, and authorizations.

03

No Medical Advice; No Provider-Patient Relationship

The Platform and all ne1 materials are for informational, observational, data-collection, research, and educational purposes only.

ne1 does not practice medicine. ne1 does not diagnose, treat, cure, mitigate, or prevent any disease or condition. ne1 does not create a physician-patient, provider-patient, pharmacist-patient, therapist-patient, researcher-subject clinical care, fiduciary, or other professional relationship with you.

No content on the Platform, including user submissions, graphs, dashboards, summaries, statistical analyses, comments, publications, social-media posts, case summaries, or AI-generated outputs, is medical advice or a substitute for professional medical judgment.

You are solely responsible for consulting qualified licensed healthcare professionals before making any health-related decision.

04

Peptides, Research Compounds, and High-Risk Substances

You understand and agree that:

  1. peptides, research chemicals, compounded substances, investigational compounds, supplements, medications, hormones, biologics, injectable products, and similar substances may involve serious and unpredictable risks, including infection, allergic reaction, immune reaction, contamination, mislabeling, dosing error, drug interaction, organ injury, disability, hospitalization, or death;
  2. some substances discussed or reported by users may be unapproved, investigational, prescription-only, mislabeled, adulterated, counterfeit, illegally marketed, unlawfully obtained, or unlawful to possess, import, prescribe, dispense, compound, advertise, or use in certain jurisdictions;
  3. ne1 does not verify the legality, quality, identity, purity, sterility, dose, route, source, safety, efficacy, or appropriateness of any compound;
  4. user-reported data may be inaccurate, incomplete, fabricated, biased, confounded, non-generalizable, or unsafe to imitate;
  5. the presence of any compound, dose, route, schedule, outcome, protocol-like description, anecdote, chart, or discussion on the Platform does not mean ne1 endorses it or that it is safe, legal, effective, advisable, or medically appropriate.

The FDA has publicly identified safety concerns for certain bulk drug substances used in compounding, including several peptides, citing issues such as immunogenicity, impurities, limited safety information, and lack of sufficient information to know whether some substances would cause harm when administered to humans. This regulatory background reinforces why ne1’s Platform must not be used as a source of medical instructions or recommendations.

05

Emergency and Safety Notice

The Platform is not monitored as an emergency service. ne1 does not promise to review, triage, escalate, respond to, or act on any symptom report, adverse event, laboratory result, message, comment, or uploaded data.

If you believe you may be experiencing a medical emergency, serious adverse event, overdose, allergic reaction, infection, suicidal ideation, or any urgent health issue, call emergency services immediately and contact a licensed medical professional.

You are solely responsible for reporting adverse events to your healthcare provider, product manufacturer, pharmacy, poison control center, regulator, or other appropriate authority. ne1 may, but is not obligated to, review, remove, preserve, escalate, or report content where we believe doing so is appropriate or legally required.

06

User Data You Submit

“User Data” means any information, content, files, records, entries, comments, survey responses, lab values, biomarker data, wearable data, images, documents, subjective reports, adverse-event reports, compound-use history, medical history, demographic information, lifestyle information, metadata, or other materials you submit to or through the Platform.

User Data may include sensitive health information. You should not upload direct identifiers unless a specific field asks for them. Direct identifiers include names, addresses, phone numbers, email addresses, precise dates of birth, government ID numbers, medical record numbers, insurance numbers, full-face photographs, unredacted lab reports, prescription labels, pharmacy receipts, provider names, clinic names, supplier names, or other information that identifies you or another person.

You are responsible for reviewing and redacting uploaded documents before submission. ne1 may offer tools to assist with redaction or de-identification, but you remain responsible for what you upload.

07

Data Accuracy and User Responsibility

You represent and warrant that, to the best of your knowledge:

  1. your User Data is accurate and not intentionally misleading;
  2. you have the right to submit the User Data;
  3. your User Data does not violate any law, contract, confidentiality duty, intellectual-property right, privacy right, or third-party right;
  4. your submission does not include data about another person without all required authorizations;
  5. you are not submitting data to obtain medical advice, dosing instructions, diagnosis, treatment, emergency support, legal advice, or regulatory advice;
  6. your use of the Platform is voluntary and not induced by ne1 to start, stop, change, or continue any compound, medication, supplement, therapy, or self-experiment.

ne1 may reject, edit, normalize, code, classify, annotate, transform, de-identify, aggregate, remove, or restrict User Data at any time, with or without notice.

08

License to User Data

You retain whatever ownership rights you have in your User Data. However, by submitting User Data, you grant ne1 a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free, fully paid license to host, store, copy, reproduce, process, clean, normalize, code, classify, tag, translate, redact, de-identify, pseudonymize, anonymize, aggregate, analyze, combine, compare, transform, create derivative works from, display, publish, distribute, disclose, commercialize, and otherwise use your User Data as described in these Terms.

This license includes the right to use User Data and derivative data for:

  1. operating and improving the Platform;
  2. maintaining your account;
  3. quality control and fraud prevention;
  4. privacy, security, and compliance operations;
  5. retrospective research;
  6. IRB-reviewed, IRB-exempt, IRB-waived, or IRB-determined research;
  7. statistical analyses;
  8. academic manuscripts and journal submissions;
  9. conference abstracts, posters, and presentations;
  10. preprints;
  11. public reports, white papers, and educational materials;
  12. social-media content and informal publications;
  13. de-identified case summaries and vignettes;
  14. dashboards and public-facing aggregate summaries;
  15. development, validation, and improvement of analytics, algorithms, models, machine-learning systems, and research tools;
  16. collaborations with academic, clinical, nonprofit, commercial, regulatory, publishing, or research partners;
  17. any other lawful research, public-interest, educational, product-development, or business purpose consistent with the Privacy Notice.

For identifiable User Data, ne1’s use is subject to the Privacy Notice and applicable law. For de-identified, anonymized, pseudonymized, aggregated, statistical, or derivative data, the license is irrevocable and survives deletion of your account, withdrawal from the Platform, termination of these Terms, or your death, to the maximum extent permitted by law.

09

Data Contribution and Research Use Consent

By submitting User Data, you voluntarily consent to ne1 using your User Data for retrospective research and related publications.

You understand and agree that:

  1. your data may be used to study self-reported experiences, exposures, outcomes, risks, trends, associations, adverse events, biomarker changes, behavioral patterns, and other research questions;
  2. research may include peptides, medications, supplements, devices, lifestyle interventions, diagnostics, labs, wearable metrics, subjective outcomes, and other user-reported exposures;
  3. ne1 may combine your data with data from other users and with publicly available, licensed, partner-provided, or third-party datasets;
  4. ne1 may use your data in coded, de-identified, pseudonymized, anonymized, aggregated, statistical, or derivative form;
  5. ne1 may submit analyses to an institutional review board, ethics committee, journal, conference, data repository, regulator, or research partner;
  6. research may be reviewed by an IRB, determined exempt, determined not to be human-subjects research, or subject to waiver or alteration of consent, depending on the protocol and applicable law;
  7. you will not receive medical care, diagnosis, treatment, monitoring, or individualized clinical interpretation through research participation;
  8. you may not directly benefit from contributing data;
  9. others may benefit from knowledge generated through the research;
  10. research findings may be negative, positive, inconclusive, preliminary, corrected, updated, challenged, or withdrawn;
  11. ne1 may generate intellectual property, datasets, models, publications, products, services, reports, or commercial value from the data and owes you no compensation, ownership interest, royalty, authorship, attribution, approval right, or accounting;
  12. ne1 is not required to include your data in any study or publication;
  13. you have no right to review, edit, approve, block, retract, or control any publication or public communication that uses de-identified, anonymized, aggregated, statistical, or derivative data.

Nothing in this research consent is intended to require you to waive legal rights that cannot legally be waived. For covered human-subjects research, ne1 will follow applicable IRB and research-consent requirements.

10

Withdrawal and Deletion

You may stop using the Platform at any time. You may request deletion of your account or certain identifiable information by following the process in the Privacy Notice.

However, you understand and agree that:

  1. ne1 may retain data as required or permitted by law;
  2. ne1 may retain records needed for security, fraud prevention, regulatory compliance, audit, dispute resolution, legal claims, research integrity, publication support, and backup systems;
  3. ne1 is not required to delete de-identified, anonymized, aggregated, statistical, or derivative data;
  4. ne1 is not required to retract, revise, delete, or stop using analyses, publications, datasets, models, reports, social-media posts, conference materials, journal submissions, peer-review materials, preprints, public summaries, or other outputs that have already been created, submitted, published, shared, relied on, or incorporated into ongoing work;
  5. withdrawal may not be possible for data that has already been de-identified, aggregated, anonymized, incorporated into analyses, or shared with research collaborators under data-use controls.
11

Privacy, De-Identification, and Confidentiality

ne1 will maintain a Privacy Notice describing how we collect, use, disclose, retain, and protect personal information.

ne1 will make reasonable efforts to protect identifiable User Data using administrative, technical, and organizational safeguards appropriate to the nature of the data. ne1 will seek to publish only de-identified, anonymized, aggregated, statistical, or otherwise privacy-protective information, unless you have given separate explicit permission or disclosure is legally required.

ne1 may use de-identification, pseudonymization, coding, aggregation, suppression, generalization, redaction, access controls, data minimization, separation of identifiers, or similar methods. De-identified data may still carry some residual risk of re-identification, especially where rare conditions, unusual combinations of variables, precise dates, granular geography, free-text descriptions, images, lab reports, or small cohorts are involved. You accept this residual risk.

ne1 does not promise that any data is absolutely anonymous, immune from breach, immune from misuse, or impossible to re-identify.

12

Public and Community Content

Some Platform features may allow users to post comments, narratives, charts, usernames, profile information, or other content visible to other users or the public.

If you post content publicly or semi-publicly, you understand that others may view, copy, screenshot, download, index, quote, share, misuse, or re-identify that content. ne1 is not responsible for third-party use of information you choose to make public.

Do not post direct identifiers, supplier links, purchasing instructions, provider names, clinic names, pharmacy names, defamatory statements, threats, harassment, illegal content, or another person’s private information.

13

Prohibited Conduct

You may not use the Platform to:

  1. seek or provide medical advice, dosing instructions, prescribing guidance, diagnosis, treatment, or emergency support;
  2. encourage, instruct, pressure, solicit, coordinate, or induce anyone to use any peptide, drug, compound, medication, supplement, device, protocol, or self-experiment;
  3. sell, advertise, market, broker, source, refer, distribute, ship, compound, prescribe, dispense, import, or facilitate access to any compound or health product;
  4. post supplier names, supplier links, coupon codes, marketplace links, pharmacy workarounds, importation instructions, compounding instructions, synthesis instructions, or other procurement guidance;
  5. submit false, fraudulent, manipulated, malicious, defamatory, or misleading content;
  6. upload another person’s health information without authorization;
  7. upload unredacted medical records, lab reports, prescriptions, IDs, photos, or documents containing direct identifiers unless expressly requested through a secure workflow;
  8. violate any law, regulation, court order, professional rule, contract, or third-party right;
  9. scrape, crawl, harvest, download, resell, re-identify, deanonymize, link, or attempt to identify users or datasets;
  10. use Platform content to train external models, build competing datasets, conduct surveillance, profile individuals, make employment, insurance, credit, housing, educational, legal, or eligibility decisions, or engage in discrimination;
  11. interfere with security, access controls, rate limits, authentication, or Platform operations;
  12. upload malware, tracking code, spyware, or harmful files;
  13. harass, threaten, exploit, or abuse other users;
  14. impersonate any person or entity;
  15. imply that ne1 endorses you, your content, your products, your services, your protocol, or your conclusions.

ne1 may suspend or terminate accounts, remove content, restrict features, preserve evidence, cooperate with authorities, or take other action if we believe these Terms have been violated or if action is needed to protect users, ne1, research integrity, or the public.

14

No Reliance on User Content or Platform Outputs

The Platform may include user-submitted data, anecdotes, self-experiment reports, charts, comments, summaries, aggregate trends, statistical outputs, AI-generated outputs, research hypotheses, and preliminary findings. These materials may be incomplete, incorrect, biased, fabricated, confounded, outdated, or not applicable to you.

You agree not to rely on Platform content as medical, scientific, legal, regulatory, safety, or purchasing advice. Any interpretation of Platform content must be reviewed with qualified professionals.

15

No Validation of Products, Protocols, or Claims

ne1 does not verify, validate, endorse, certify, approve, or recommend any:

  1. compound;
  2. peptide;
  3. medication;
  4. supplement;
  5. device;
  6. laboratory test;
  7. clinic;
  8. pharmacy;
  9. prescriber;
  10. vendor;
  11. source;
  12. brand;
  13. protocol;
  14. dosage;
  15. route of administration;
  16. schedule;
  17. combination;
  18. outcome claim;
  19. safety claim;
  20. efficacy claim.

Any report of use, non-use, benefit, adverse event, or outcome is merely a user-reported observation unless ne1 expressly states otherwise in a formal publication.

16

Research Integrity and Publication Rights

ne1 may publish or share de-identified, anonymized, aggregated, statistical, coded, or derivative findings through formal and informal channels, including journals, preprints, conferences, posters, websites, newsletters, podcasts, videos, investor materials, press releases, social media, educational materials, regulatory submissions, and public dashboards.

ne1 may edit, summarize, paraphrase, visualize, suppress, generalize, or exclude data to protect privacy, improve clarity, comply with journal or IRB requirements, reduce re-identification risk, improve data quality, or support research integrity.

ne1 may correct, update, retract, or amend publications or summaries in its discretion, but has no obligation to do so at your request unless required by law.

17

Commercialization and Intellectual Property

You understand that ne1 may develop products, services, datasets, software, algorithms, models, reports, dashboards, publications, intellectual property, know-how, research assets, and commercial relationships using User Data and derivative data.

As between you and ne1, ne1 owns all rights in the Platform, software, databases, schemas, taxonomies, data models, analytics, de-identified datasets created by ne1, aggregated datasets, statistical outputs, derivative works, publications, visualizations, trademarks, logos, and other ne1 materials, except for your underlying rights in your original User Data.

You are not entitled to payment, royalties, equity, authorship, attribution, review rights, approval rights, license fees, or other compensation from ne1’s use of User Data or derivative data.

18

Third-Party Partners and Service Providers

ne1 may share User Data, including identifiable data where permitted by the Privacy Notice and applicable law, with service providers, contractors, researchers, academic institutions, IRBs, ethics committees, journals, peer reviewers, legal advisors, security vendors, cloud providers, analytics vendors, compliance vendors, regulators, transaction counterparties, and other partners.

Where appropriate, ne1 will use contractual, technical, organizational, or policy controls designed to restrict misuse of data. However, ne1 is not responsible for independent acts or omissions of third parties except to the extent required by law.

19

Legal and Regulatory Disclosures

ne1 may access, preserve, use, or disclose information if we believe in good faith that doing so is reasonably necessary to:

  1. comply with law, regulation, subpoena, court order, legal process, government request, IRB requirement, journal requirement, or regulatory obligation;
  2. enforce these Terms;
  3. investigate potential violations, fraud, abuse, security incidents, or illegal activity;
  4. protect the rights, property, safety, privacy, reputation, or security of ne1, users, researchers, partners, or the public;
  5. respond to claims that content violates third-party rights;
  6. support audits, compliance, research integrity, or publication review.
20

Security

ne1 will use reasonable safeguards designed to protect the Platform and identifiable User Data. However, no security system is perfect. You understand and accept that unauthorized access, cyberattacks, system failures, human error, data loss, corruption, or breaches may occur.

You are responsible for keeping your login credentials confidential, using secure devices and networks, and promptly notifying ne1 of suspected unauthorized access to your account.

21

Account Suspension and Termination

ne1 may suspend, restrict, or terminate your account or access to the Platform at any time if we believe:

  1. you violated these Terms;
  2. your use creates legal, regulatory, privacy, safety, security, reputational, research-integrity, or operational risk;
  3. your content may be unlawful, harmful, misleading, defamatory, infringing, unsafe, or inconsistent with ne1’s mission;
  4. continued access may harm ne1, users, researchers, partners, or the public.

Termination does not affect ne1’s rights to retain and use User Data, de-identified data, aggregated data, derivative data, records, analyses, or publications as described in these Terms.

22

Disclaimers of Warranties

To the maximum extent permitted by law, the Platform and all content, data, outputs, publications, tools, analyses, and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

ne1 disclaims all warranties, including warranties of accuracy, completeness, reliability, validity, safety, legality, efficacy, merchantability, fitness for a particular purpose, title, non-infringement, availability, security, confidentiality, error-free operation, uninterrupted access, regulatory compliance for your intended use, and medical or scientific usefulness.

ne1 does not warrant that:

  1. Platform content is accurate or complete;
  2. User Data is truthful or reliable;
  3. any compound is safe, legal, effective, pure, sterile, correctly labeled, or appropriate;
  4. any analysis will produce meaningful results;
  5. any publication will be accepted, accurate, or useful;
  6. the Platform will identify medical risks or adverse events;
  7. the Platform will prevent harm;
  8. data will be absolutely anonymous or impossible to re-identify;
  9. data will never be breached, lost, corrupted, or accessed without authorization.
23

Assumption of Risk

You voluntarily assume all risks arising from:

  1. your health-related decisions;
  2. your use or non-use of any compound, medication, supplement, device, laboratory test, intervention, or self-experiment;
  3. your reliance on any user content, Platform content, publication, or third-party content;

You agree that ne1 is not responsible for injuries, losses, adverse events, medical outcomes, legal consequences, or damages arising from decisions or conduct undertaken independently by you or any third party.

24

Limitation of Liability

To the maximum extent permitted by law, ne1 and its affiliates, officers, directors, employees, contractors, researchers, advisors, agents, licensors, service providers, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, or similar damages, including lost profits, lost revenue, lost data, loss of goodwill, reputational harm, business interruption, personal injury, emotional distress, medical expense, adverse health outcome, regulatory consequence, or loss arising out of or relating to the Platform, User Data, research, publications, social-media content, third-party content, or these Terms.

To the maximum extent permitted by law, ne1’s total aggregate liability for all claims arising out of or relating to the Platform, User Data, research, publications, social-media content, third-party content, or these Terms will not exceed the greater of:

(a) the amount you paid ne1, if any, in the twelve months before the event giving rise to the claim; or

(b) USD $100.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.

Nothing in these Terms excludes liability that cannot legally be excluded.

25

Indemnification

You agree to defend, indemnify, and hold harmless ne1 and its affiliates, officers, directors, employees, contractors, researchers, advisors, agents, licensors, service providers, successors, and assigns from and against all claims, demands, actions, investigations, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  1. your use or misuse of the Platform;
  2. your User Data;
  3. your violation of these Terms;
  4. your violation of law or third-party rights;
  5. your health-related decisions or self-experimentation;
  6. your use, purchase, possession, importation, compounding, administration, dosing, combination, or sourcing of any compound;
  7. your interaction with another user or third party;
  8. your submission of third-party data without authorization;
  9. any claim that your content is false, misleading, defamatory, infringing, unlawful, or harmful;
  10. any attempt to re-identify, scrape, misuse, commercialize, or improperly disclose Platform data.

ne1 reserves the right to control the defense of any matter subject to indemnification. You agree to cooperate with ne1’s defense.

26

Arbitration, Class Action Waiver, and Dispute Resolution

Please read this section carefully. It affects your legal rights.

Before filing a claim, you agree to first contact ne1 at legal@ne1.study and attempt to resolve the dispute informally. If the dispute is not resolved within 60 days, either party may initiate binding arbitration, except for claims that may be brought in small claims court or claims seeking injunctive relief for unauthorized access, misuse of data, intellectual-property infringement, confidentiality breaches, or security violations.

Any arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules. The seat of arbitration will be Boulder, Colorado, unless applicable law requires otherwise. The arbitration will be conducted on an individual basis only.

You and ne1 waive the right to a jury trial and waive the right to participate in any class action, collective action, consolidated action, private attorney general action, or representative proceeding, to the maximum extent permitted by law.

If the class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not arbitration, unless applicable law provides otherwise.

You may opt out of arbitration by sending written notice to legal@ne1.study or EMBR LLC, 1803 S Foothill Pkwy, Boulder, CO 80303 within 30 days after first accepting these Terms. Your opt-out notice must include your name, account email, and a clear statement that you opt out of arbitration.

27

Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules, except to the extent preempted or overridden by applicable law.

Subject to the arbitration section, exclusive venue for disputes will be in the state or federal courts located in Boulder County, Colorado, and you consent to personal jurisdiction there.

28

Changes to the Platform or Terms

ne1 may modify the Platform or these Terms at any time. Changes become effective when posted or otherwise communicated, unless a later date is stated.

Your continued use of the Platform after changes become effective means you accept the updated Terms. If you do not agree, you must stop using the Platform.

Changes will not reduce ne1’s rights in de-identified, anonymized, aggregated, statistical, or derivative data already created, used, shared, or incorporated into research, publications, or Platform operations.

29

Additional Terms for Mobile Apps, APIs, or Integrations

If you use a mobile app, API, wearable integration, lab integration, third-party data import, or connected service, additional terms may apply. You authorize ne1 to collect and process data made available through such integrations according to the permissions you grant and the Privacy Notice.

ne1 is not responsible for third-party platforms, devices, labs, apps, APIs, or services.

30

Export, Sanctions, and International Use

You may not use the Platform in violation of export controls, sanctions, embargoes, or other applicable trade restrictions. You are responsible for complying with laws in your jurisdiction.

If you access the Platform from outside the United States, you understand that your information may be processed in the United States and other jurisdictions that may have different privacy laws than your location.

31

Notices

ne1 may provide notices through the Platform, by email, by posting on our website, or by other reasonable means.

Legal notices to ne1 must be sent to: ne1 Legal Department, EMBR LLC, 1803 S Foothill Pkwy, Boulder, CO 80303, legal@ne1.study.

32

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

33

No Waiver

ne1’s failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

34

Assignment

You may not assign or transfer these Terms without ne1’s prior written consent. ne1 may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction, change of control, or by operation of law.

35

Entire Agreement

These Terms, the Privacy Notice, and any supplemental terms constitute the entire agreement between you and ne1 regarding the Platform and supersede all prior or contemporaneous agreements on that subject.

36

Survival

Sections concerning medical disclaimers, peptide and compound warnings, data licenses, research consent, withdrawal limits, publication rights, intellectual property, privacy and de-identification limits, prohibited data misuse, disclaimers, assumption of risk, limitation of liability, indemnification, arbitration, governing law, and any provisions that by their nature should survive will survive termination of these Terms.

Clickwrap consent · required to contributeNE1 / Consent

Before submitting any data, you will be asked to confirm the following:

  • I understand and agree that ne1 is not providing medical advice and does not recommend, encourage, prescribe, supply, validate, or endorse any peptide, medication, supplement, research chemical, compound, protocol, dose, route, source, or self-experiment. I understand that all health decisions should be made with a qualified licensed medical professional.
  • I voluntarily submit my data to ne1 and authorize ne1 to use my data, including de-identified, anonymized, pseudonymized, aggregated, statistical, and derivative versions of my data, for retrospective research, IRB-reviewed or IRB-determined studies, publications, social-media summaries, educational materials, analytics, model development, and other research or public-interest purposes described in the Terms.
  • I understand that ne1 will make reasonable efforts to protect privacy and avoid publishing information that directly identifies me, but no system or de-identification method can guarantee absolute anonymity, security, confidentiality, or zero risk of re-identification.
  • I understand that I will not receive medical care, individualized medical interpretation, compensation, ownership, royalties, authorship, or publication approval rights from contributing data. I understand that withdrawal or account deletion may not affect data already de-identified, aggregated, analyzed, shared, submitted, published, incorporated into research, or retained as permitted by the Terms.

I have read and agree to the ne1 Terms of Service, Privacy Notice, and Data Contribution and Research Use Consent.
